TipTree.io Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TipTree.io (the “Platform”), operated by TipTree.io, LLC, a Minnesota limited liability company (“TipTree,” “we,” “us,” or “our”).

By accessing or using TipTree.io, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. User Roles

TipTree supports multiple user roles:

  • Artists – musicians, performers, or creators who use TipTree to receive tips, fan support, and subscriptions.

  • Fans – individuals who voluntarily tip Artists, submit requests, messages, or subscribe to Artist offerings.

  • Administrators – TipTree internal users.

Artists and Fans are separate user roles and agree to these Terms upon account creation or use.

3. Account Creation & Eligibility

  • You must be at least 18 years old to use TipTree.

  • You are responsible for maintaining the security of your account credentials.

  • You agree that all information you provide is accurate and current.

TipTree reserves the right to suspend or terminate accounts for violations of these Terms.

4. Payments & Fees

Payment Processing

All payments are processed through Stripe, including Stripe Connect where applicable.

Fees

  • Artists pay a subscription fee to use TipTree.

  • Fans pay:

    • All Stripe processing fees

    • Any applicable TipTree transaction fees

  • Artists do not pay transaction fees on tips.

Merchant of Record

The merchant of record may vary depending on the transaction type. In most cases, the Artist is the merchant of record.

Chargebacks & Disputes

  • Chargebacks are typically handled through the Artist’s connected Stripe account.

  • TipTree may assist administratively but is not responsible for resolving disputes between Fans and Artists.

5. Tips, Requests & Subscriptions

  • Tips are voluntary gratuities.

  • Tips do not guarantee:

    • A song performance

    • Fulfillment of a request

    • Any specific outcome

  • Tips are non-refundable unless required by law.

Artists may:

  • Set request-based tip amounts

  • Offer subscriptions

  • Create one-time offers or fan funnels

6. One-Time Offers, Merch & Fulfillment

TipTree does not:

  • Handle shipping or fulfillment

  • Control product quality

  • Guarantee availability or delivery

All fulfillment responsibility lies solely with the Artist.

7. Artist Status

Artists are customers of TipTree, not employees, partners, agents, or contractors of TipTree.

Artists are solely responsible for:

  • Their performances

  • Offers and fulfillment

  • Tax obligations

  • Legal compliance

8. Prohibited Conduct

You may not use TipTree to engage in:

  • Illegal activity

  • Fraud or deception

  • Hate, harassment, or discrimination

  • Explicit or pornographic content

  • Copyright or intellectual-property violations

TipTree may suspend or terminate accounts at its discretion.

9. Content & Intellectual Property

  • Artists retain ownership of their content.

  • Fans retain ownership of their submissions.

  • By using TipTree, users grant TipTree a non-exclusive, worldwide, royalty-free license to host, display, and operate the Platform using submitted content.

Artists may manage marketing permissions through account notification settings.

10. Communications & Data

TipTree may send:

  • Transactional emails

  • Platform notifications

  • Optional marketing communications

Fan contact data belongs to the Artist.
Artists may export their fan data.

11. Account Termination

  • Users may delete their accounts at any time.

  • TipTree may terminate accounts for:

    • Violations

    • Non-payment

    • Inactivity

  • Certain provisions survive termination, including payment obligations and liability limitations.

12. Disclaimers

TipTree provides the Platform “as is” and “as available.”

We make no warranties regarding:

  • Artist quality

  • Performance availability

  • Fulfillment of offers

  • Platform uptime

13. Limitation of Liability

To the maximum extent permitted by law, TipTree shall not be liable for indirect, incidental, consequential, or punitive damages.

Total liability shall not exceed the amount paid to TipTree by the user in the prior 12 months.

14. Indemnification

You agree to indemnify and hold harmless TipTree.io, LLC from claims arising from:

  • Your use of the Platform

  • Your content

  • Your transactions or interactions with others

15. Arbitration & Class Action Waiver

All disputes shall be resolved through binding arbitration under Minnesota law.

You waive the right to participate in class actions or jury trials.

16. Future Features

These Terms apply to future TipTree features, including:

  • Subscriptions

  • Digital content

  • Physical merchandise

  • Booking tools

  • Native mobile applications

17. Geographic Scope

TipTree is currently available to U.S. users only.

18. Changes to Terms

TipTree may update these Terms at any time. Continued use constitutes acceptance of updated Terms.
